Terms of use for forum attendees
These Terms of Use (hereinafter referred to as "Terms of Use") are the online shops (hereinafter referred to as "service") provided by PACIFICO Yokohama (hereinafter referred to as PACIFICIO") on this website. Registered users (hereinafter referred to as "users") are required to use this service in accordance with this agreement.
Article 1 (Applicable)
This agreement shall apply to all relationships regarding to the use of this service between users and PACIFICO.
Regarding this service, in addition to this agreement, we may make various provisions (hereinafter referred to as "individual provisions") such as cancel policy. These individual provisions shall form part of this agreement regardless of their name.
If the provisions of this agreement contradict the provisions of the individual provisions in the preceding paragraph, the provisions of the individual provisions shall prevail unless otherwise specified in the individual provisions.
Article 2 (User Registration)
In this service, the registration applicant agrees to this agreement, applies for user registration by the method specified by PACIFICO, and PACIFICO notifies the registration applicant of the approval for this, and the user registration is completed.
PACIFICO may not approve the application for user registration if it determines that the registration applicant has the following reasons, and shall not be obliged to disclose the reason.
(1) When false information is reported when applying for user registration
(2) When the application is from a person who has violated this agreement
(3) When we judge that the user registration is not appropriate
Article 3 (Management of QR Code)
The user shall manage the QR code of this service at his / her own risk.
Under no circumstances may the user transfer or lend the QR code to a third party or share it with a third party. When PACIFICO scans QR code to verify the registered information, PACIFICO will consider it to be used by the user who has been provided that QR code.
PACIFICO shall not be liable for any damages caused by the use of the QR code by a third party, unless PACIFICO has intentional misconduct or gross negligence.
Article 4 (Sales Agreement)
In this service, the sales agreement shall be concluded when users apply for registration to PACIFICO and notifies PACIFICO that the application has been accepted. PACIFICO shall be able to cancel the sales agreement without notifying users in advance if users falls under any of the following reasons.
(1) If the user violates these Terms of Use
(2) When we admit that the relationship of trust between PACIFICO and users has been broken
The payment method and the cancellation method of the applied user registration, etc. related to this service will be determined separately by PACIFICO.
Article 5 (Intellectual Property Rights)
The copyright or other intellectual property rights of product photos and other content (hereinafter referred to as "content") provided by this service belong to PACIFICO and legitimate right holders such as content providers. Users may not reproduce, reprint, modify, or otherwise use for secondary purposes without permission of PACIFICO.
Article 6 (Prohibited Matters)
Users shall not do the following acts when using this service.
(1) Acts that violate the law or public order and morals
(2) Acts related to criminal acts
(3) Acts that infringe copyrights, trademark rights and other intellectual property rights included in this service
(4) Acts that destroy or interfere with the functionality of our servers or networks
(5) Acts of using the information obtained from this service commercially
(6) Acts that may interfere with the operation of this service
(7) Acts of unauthorized access or attempting unauthorized access
(8) Acts of collecting or accumulating personal information about other users
(9) Acts of impersonating another user
(10) Acts that directly or indirectly benefit antisocial forces in connection with this service
(11) Other acts that PACIFICO judges inappropriate
Article 7 (Suspension of Provision of This Service, etc.)
If PACIFICO determines that there is any of the following reasons, we may stop or suspend providing all or part of this service without notifying users in advance.
(1) When performing maintenance, inspection or updating of the computer system related to this service
(2) When it becomes difficult to provide this service due to force majeure such as an earthquake, lightning strike, fire, power outage or natural disaster
(3) When the computer or telecommunication line stops due to an accident
(4) When we judge that it is difficult to provide this service
PACIFICO shall not be liable for any disadvantage or damage suffered by users or a third party due to the suspension or interruption of providing of this service regardless of the reason.
Article 8 (Usage Restrictions and Deregistration)
PACIFICO shall be able to restrict the use of all or part of this service to users or cancel the registration without prior notice in any of the following cases.
(1) When users violate any provision of these Terms of use
(2) When false information is reported in the registered information
(3) When the credit card notified by the user as a payment method is suspended
(4) When there is a default of payment obligations such as fees
(5) When there is no response to the contact from PACIFICO for a certain period of time
(6) When we judge that the use of this service is not appropriate
PACIFICO shall not be liable for any damage caused to users due to the actions taken by PACIFICO based on this article.
Article 9 (Disclaimer of Warranty)
PACIFICO shall not guarantee that no practical or legal defects (including safety, reliability, accuracy, completeness, effectiveness, and suitability for a specific purpose, security defects, errors and bugs, infringement of rights, etc.) may be found in this service.
PACIFICO shall not take any responsibility for any damage caused users by this service. However, if the contract between users and PACIFICO regarding this service (including this Terms of use) is a consumer contract stipulated in the Consumer Contract Law, this disclaimer will not apply. Nevertheless, PACIFICO shall not take any responsibility for the damage caused by special circumstances among the damages (including when PACIFICO has foreseen the damage or the damage may be foreseen) caused to users due to default or illegal acts by negligence (excluding gross negligence) of PACIFICO.
PACIFICO shall not take responsibility for any transactions, communications or disputes that occur users or between users and third parties regarding this service.
Article 10 (Changes in Service Content, etc.)
PACIFICO shall be able to change the contents of this service without notifying users and shall not be liable for any damage caused to users.
Article 11 (Change of Terms of use)
PACIFICO shall be able to change these Terms of use at any time without notifying users if it deems necessary. If users start using this service after changing this agreement, users will be deemed to have agreed to the changed Terms of use.
Article 12 (Handling of Personal Information)
PACIFICO will handle personal information acquired by using this service appropriately in accordance with our "Privacy Policy".
Article 13 (Notification or Contact)
Notification or communication between users and PACIFICO shall be made by the method specified by PACIFICO. PACIFICO considers that the currently registered contact is valid and notifies or contacts unless users notifies the change according to the method specified separately by PACIFICO, and the contact has been reached.
Article 14 (Prohibition of Transfer of Rights and Obligations)
Users may not assign the status under the sales agreement or the rights or obligations based on these Terms of use to a third party or provide it as collateral without the prior written consent of PACIFICO.
Article 15 (Governing law and Jurisdiction)
These Terms of Use shall be construed and interpreted in accordance with the laws of Japan.
Any and all disputes arising out of or in connection with this service shall submit to the exclusive agreed jurisdiction of the Yokohama District Court at the first instance.
(Cancellation Policy)
1.PACIFICO is unable to refund the registration fee in case of cancellation at your convenience.
2. If you are unable to attend the forum on the day of the event due to circumstances, please let us know as far in advance as possible. (In such cases, the registration fee will not be refunded.)
3. If a registered person is unable to attend due to circumstances, it is possible to change the participants within the same organisation. In such cases, please make sure to contact us in advance to change the registration details.
There will be no additional costs associated with the above changes.
(Privacy Policy)
1. Personal Information Compliance and Management
PACIFICO protects personal information in its possession pursuant to the laws and regulations (including the Personal Information Protection Law) and appoints the representative manager at each department to handle and manage the personal information appropriately.
PACIFICO draws up personal information protection regulations and give all employees the guidance in order to prevent unauthorized access to, and loss, destruction, modifications and leakage of personal information.
2. Acquisition of Personal Information
PACIFICO acquires personal information through legal and fair measures by clarifying the purpose, the range of use and PACIFICO's contact persons.
3. Use Purpose of Personal Information
PACIFICO uses the personal information obtained from its customers for the following purposes.
For PACIFICO's facilities and procedures and contact information necessary for its business activities.
(1) For public relations for PACIFICO's facilities and business activities
(2) For statistics and analysis on use of the facilities and provision of services
(3) For developing new services and businesses and for conducting questionnaires on customer satisfaction
(4) For sending PACIFICO's public relations magazines, event brochures and invitation cards
(5) For following the guidance and the instructions made by the administrative authorities
(6) For the purposes clearly specified upon acquisition of personal information
4. Limited Use of Personal Information
PACIFICO uses its customers' personal information for the purposes specified in 3 above only.
When the personal information is to be used for any purpose other than the above, PACIFICO will give an advance notice to the customer.
5. Limited Provision of Personal Information to Third Parties
PACIFICO does not disclose or provide its customers' personal information to any third party except in the following cases.
(1) Where PACIFICO obtains the customer's prior consent
(2) Where provision of personal information is permitted by laws and regulations
(3) Where provision of information is necessary to cooperate with administrative authorities for a special reason
PACIFICO may share its customers' personal information with the designated contractors or outsource handling of the personal information to other contractors in order to fulfill its responsibilities specified in the contract with the customer and to provide better facilities and services.
In accordance with the nondisclosure agreement, PACIFICO prevents leakage of personal information from and the secondary provision by the contractors and handle, manage and control the information properly.
6. Disclosure, Correction and Deletion of Personal Information
If any customer requests disclosure, correction or deletion of his personal information, PACIFICO will sincerely and promptly respond to such a request after confirming the customer's identity, except in the following cases.
(1) Where damage to the life, body and property of the customer or the third parties may be caused or other rights may be infringed
(2) Where public safety and order may not be ensured
(3) Where PACIFICO's business may be obstructed
(4) Where PACIFICO cannot disclose the personal information under the laws and regulations
(5) Where PACIFICO cannot confirm the customer's identity
7. Continuous Review of Personal Information
PACIFICO will make effort to review and improve the regulations and the management system of personal information, including this Privacy Policy.
(Privacy Notice for Events)
1. Conditions for "Ordinary" personal data
(1) Users agree that PACIFICO may process personal data of users on the CRM system used by PACIFICO, and may communicate with users via email, post or other methods with important messages relating to the forum.
(2) Users agree that PACIFICO may add personal data of users to their CRM system, where PACIFICO maintains records of the forum participants.
2. Special opt-in conditions for Sensitive personal data
PACIFICO will always handle some personal data regarded as particularly sensitive with an appropriate level of care.
3. Photography and Video material
Photos and videos taken at the forum may be reproduced in educational programs of the forum, promotional or news material and the promotional material of PACIFICO. This includes but is not limited to any print or electronic media (including social media) and websites.
PACIFICO reserve the right to crop, splice, treat and edit any imagery or photographs taken at the forum. Users waives the right to inspect or approve the finished product, including written or electronic copy. Additionally, all rights to royalties or other compensation arising or related to use of the name, photograph or biography are waived by users or employees of users. All photographs and video materials taken at the forum become the property of PACIFICO. The material related to this forum may not be photographed, drawn, copied or reproduced without the prior written consent of PACIFICO.
Naturally, users always have the right for their picture to be removed. Should users wish to have the picture or the video removed, please contact PACIFICO and actions will be taken accordingly.
